How to notify a user when the subprocess status is busy?

How to notify a user when the subprocess status is busy? Sometimes when we publish any incorrect document (document with some unwanted special characters), the PE server is getting stuck and all the sub processes are getting occupied (leading to "All Sub processes are currently busy" error for all subsequent document publishes).

Do we have any API to retrieve the status of the sub process ?
