Inserting a list swallows up the previous p tag

Hi there,

I am running an XML doctype and when authors try to insert an ordered or unordered list from the menu, the <p> prior to the cursor get swallowed up into the list, rather than the list starting afresh.

Any idea on how to solve this please?
